Please read these Terms and Conditions carefully before using ArizonaStock. These terms govern your access to and use of our platform and all media assets available for download. All content on this platform is owned by 1TakeMedia in collaboration with Arizona Stock.
1. Acceptance of Terms
By accessing or using ArizonaStock (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Ownership of Content
All footage, photographs, video clips, and other media assets available on ArizonaStock are licensed content owned by 1TakeMedia in collaboration with Arizona Stock. All rights not expressly granted are reserved. No content may be reproduced, distributed, or used outside the scope of the license granted at time of download without prior written consent from 1TakeMedia.
3. License Grant
Upon a successful download using credits, ArizonaStock grants you a non-exclusive, non-transferable, worldwide license to use the downloaded asset for commercial and personal digital projects including websites, social media, advertising, broadcast, and editorial use. This license does not permit resale, redistribution, or sublicensing of the asset itself or any derivative that makes the original asset extractable.
4. Prohibited Uses
You may not use any asset from ArizonaStock in a manner that: (a) is defamatory, obscene, or otherwise unlawful; (b) misrepresents the geographic location or context of the content; (c) is used to train or fine-tune machine learning or AI models without explicit written permission from 1TakeMedia; (d) infringes on the rights of any third party; or (e) violates any applicable local, state, or federal law.
5. Credit System
Access to downloadable assets requires credits purchased through the Service. Credits are non-refundable once used to download an asset. Unused credits may be refunded within 30 days of purchase. Credits have no cash value and cannot be transferred between accounts. ArizonaStock reserves the right to modify credit pricing at any time with reasonable notice.
6. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. ArizonaStock is not liable for any loss resulting from unauthorized use of your account.
7. Intellectual Property
All trademarks, service marks, logos, and brand elements displayed on ArizonaStock are the property of 1TakeMedia or their respective owners. Nothing in these Terms grants you any right to use these marks without the prior written permission of 1TakeMedia.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. ArizonaStock does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy of asset metadata, including region, resolution, or duration.
9. Limitation of Liability
To the fullest extent permitted by law, 1TakeMedia and ArizonaStock shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service or its content. Our total liability to you for any claim shall not exceed the amount you paid for the applicable credits in the 12 months preceding the claim.
10. Modifications to Terms
ArizonaStock reserves the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.
